They won't be Flying tonight

Dear Friends, We have just had confirmation form Jila's solicitor that a Judge has served an injunction stopping the deportation that had be scheduled for 17:15 today. Teesside Immigration has confirmed receipt of this. Thank you for all your support including faxes and e-mails to Government Ministers, MP's, Immigration and The Chief Executive Officer of the airline BMI. I can't stress enough how valuable this has been in getting Jila's case raised in high places.
We are looking forward to having Jila, Emad and Aref back with us on Teesside.

A better standard of misery! (More news/views on RN (Returnees) Zimbabwe)
What next for Zimbabwean claims? Fresh claims can be made by those who have no outstanding claims or appeals and upcoming appeals will be allowed on the basis of RN. Will the Home Office appeal? Probably. Will there be another Country Guidance case in a few months? Yes. Will the Home Office attempt to appeal allowed cases? Yes. Will the Home Office refuse to issue status papers until the new county guideline appeal is determined? I wouldn't be surprised, but any delay once the Home Office's appeal rights are exhausted can be challenged through judicial review. This paragraph from 'Free Movement'
Zimbabweans who are on Section Four should now be able to make a fresh claim, which will get them of section Four and back onto NASS. No great shakes but 'a better standard of misery!' no messing about finding shops that will let you spend vouchers on certain products.
Despite the clarity of RN (Returnees) Zimbabwe, please be clear new claims may not lead to refugee status the UKBA are not going to give in that easy.

Victory for Zimbabwean asylum seekers in UK
A Three-Member panel of the Asylum and Immigration Tribunal has promulgated a case called RN (Zimbabwe). RN has been designated the latest Zimbabwean Country Guidance case.
RN arrived in the United Kingdom in January 2006 and claimed asylum the following day. She held no political beliefs and had engaged in no political activities but had in the past worked as a teacher. Her claim was that as someone who did not actively support Zanu PF, she would be assumed to be a supporter of the opposition, particularly because she would be returning after spending some time in the United Kingdom. She had also fallen out with her abusive former boyfriend before fleeing Zimbabwe.
The appeal was heard over five days, and had to be especially re-convened after the agreement between President Robert Mugabe and opposition leader Morgan Tsvangirai on a power sharing arrangement was signed. The Home Office took the very unusual step of not disputing any of the country witnesses evidence, and indeed, did not cross-examine those witnesses at all. This was in part because of the impeccable credentials of the witnesses.
The Home Office's real argument was that this was not a good time for a new Guidance Case because the situation in Zimbabwe kept changing. The Tribunal disagreed, and said that there had been a significant deterioration in country conditions for ordinary Zimbabweans, and sufficient change in those country conditions to require a departure from existing country guidance. That there continues to be change in the country conditions was not a reason for the Tribunal to avoid giving guidance.

Immigration minister Phil Woolas has attacked lawyers and charities working on behalf of asylum seekers, accusing them of undermining the law and "playing the system". In an interview with the Guardian, Woolas described the legal professionals and NGO workers as "an industry", and said most asylum seekers were not fleeing persecution but were economic migrants.

Dr. Iddon: To ask the Secretary of State for the Home Department whether compensation is given or dispensation made to an applicant when the UK Border Agency accepts that it has misplaced or lost their file. [234022]
Mr. Woolas: The UK Border Agency will consider paying compensation for the financial loss of reasonable costs necessarily incurred by an individual as a consequence of documents being lost while being processed by the Agency.
