The Appellant was a citizen of Sierra Leone and member of the Temne tribe. His evidence was that his father had been involved in politics in 1977 to 1982, and that HK had been attacked by members of the Mende tribe on this account.

The Appellant was a Yemeni man born in 1942, whose former wives, children, grandchildren and brothers were all lawfully resident in the UK. He entered the UK as a visitor and applied out of time for indefinite leave to remain as a dependent relative under r 317 of the Immigration Rules.

In basic terms, the LCJ held that all that was criminalised was the destruction/disposal of a genuine and current document. If someone travels to the UK without a document, or travels on a false document and then destroys or disposes of that, they have a defence.
